Event Overview

The Office of the Arbiter for Financial Services was established by virtue of Chapter 555 of the Laws of Malta in April 2016.  It is an autonomous and independent body with the power to mediate, investigate and adjudicate complaints filed by customers against all financial services providers. 
 
The Arbiter is totally independent and impartial of all parties concerned to the complaint. 
 
The following customers may lodge a complaint with the Arbiter: 

  • Natural persons – including their successors in title; and 
  • Micro-enterprises – that is, sole traders, companies, partnerships, and cooperatives which employ fewer than 10 persons and whose annual turnover and/or annual balance sheet total does not exceed €2,000,000.





The Arbiter has the remit to investigate complaints against all financial services providers licensed or authorized by the Malta Financial Services Authority to conduct business in and from Malta.

The customer should first take up the complaint with the financial services provider concerned. If the customer is dissatisfied with the financial services provider’s reply, the customer may be able to refer the complaint to the Arbiter for Financial Service.
 
The parties are invited to a mediation process which is private and voluntary. If the parties reach an amicable settlement through mediation, the agreement is examined and authorised by the Arbiter and concludes the case.
 
If the parties fail to settle the case through mediation, it is passed to the Arbiter for Financial Services for hearing and decision. The decision of the Arbiter constitutes an executive title and is binding on the parties. There is an appeal from the decision of the Arbiter before the Court of Appeal.

Dr Reno Borg

Dr Reno Borg is the first Arbiter for Financial Services appointed on the 27 April 2016. He practised law at the Maltese Courts for 33 years.
Throughout the years, Dr Borg worked at the Office of the Prime Minister and at the Attorney General's Office. He served in diplomacy as Head of the Malta Delegation to the CSCE (now OSCE) in various conferences and also represented Malta in the Law of the Sea Conference in Geneva.
Dr Borg was legal counsel to various banks, corporations and other entities. He also served as Director on various Boards and Chaired amongst others financial institutions. Dr Borg qualified as Associate Member of the Chartered Institute of Arbitrators (London.
He also held the office of Arbiter under the Social Security Act.
Dr Borg lectures the law of civil procedure at the University of Malta.
