Event Overview

As the dust settles on the regulation of DLT, the time is right to focus on the Malta tax issues associated with the use of distributed ledger technology. Guidance issued by the Commissioner for Revenue clarifies a number of the tax issues, however a number of aspects require amplification and further analysis. This event will provide a comprehensive review of the Malta income tax, stamp duty and VAT issues as addressed in the guidance issued in November 2018 and will also focus on a number of aspects which have not been settled through the guidance.

09:15    Malta VAT Consequences applicable to DLT Transactions

The Commissioner for Revenue issued extensive guidelines on the Malta VAT treatment of transactions in DLT assets. The local VAT treatment must transpose the requirements of the EU VAT Directive and the guidance clearly attempts to do so and takes into consideration relevant recent decisions of the CJEU. This keynote shall provide a comprehensive summary of the local position as resulting from the applicable local rules and the guidance provided.

In addition to the Guidelines on the VAT implications, the key direct tax and stamp duty implications, as relevant to the application of DLT, have also been laid out in two separate Guidance notes issued by the Commissioner for Revenue in November 2018. This keynote session shall run through the above-mentioned direct tax and stamp duty implications as laid down in the Guidance notes, highlighting the tax consequences operators embracing this technology should be expected to face in the course of their day-to-day operations and transactions.

Although the guidelines issued by the Commissioner for Revenue provide a significant outline as to the tax implications relevant to this sector, there a number of issues which remain somewhat problematic and open to interpretation. The panelists shall discuss some of the outstanding issues and will share their perspective on the way forward.
